    Judge Rakoff Humiliates Mary Schapiro By Nullifying Citi MBS Settlement,



    Calls It "Neither Fair, Nor Reasonable, Nor In Public Interest"



    Once again Judge Jed Rakoff, also known as the only person in the Southern District of New York who calls out the SEC consistently and routinely on their corruption, has ruined the day for both Mary Schapiro and for Vic Pandit, by making the proposed $285 million MBS fraud settlement wrist slap null and void,

    and setting a trial date for July 16, 2012 in which Citigroup will actually face a jury and defend itself to peers instead of to future Citi employees in the form of SEC porn addicts.

    It is unclear if the reversal is a bigger slap in the face for Citi or for the SEC, but one thing is certain: both parties are to be massively embarassed as a result of this ruling which essentially says that both entities are culpable -

    the first of committing a far greater crime than the $285 mm fine deems fit,

    and the second of being a complicit enabler of precisely this kind of criminal behavior which it then fines with some token amount and things can continue as they were.

    And just like in the case of SEC vs BofA, Rakoff crucifies the SEC's worthless organizationL: "the Court concludes, regretfully, that the proposed Consent Judgment is neither fair, nor reasonable, nor adequate, nor in the public interest."

    He continues: "Most fundamentally, this is because it does not provide the Court with a sufficient evidentiary basis to know whether the requested relief is justified under any of these standards. Purely private parties can settle a case without ever agreeing on the facts, for all that is required is that a plaintiff dismiss his complaint.

    But when a public agency asks a court to become its partner in enforcement by imposing wide-ranging injunctive remedies on a defendant, enforced by the formidable judicial power of contempt, the court, and the public, need some knowledge of what the underlying facts are:

    for otherwise, the court becomes a mere handmaiden to a settlement privately negotiated on the basis of unknown facts, while the public is deprived of ever knowing the truth in a matter of obvious public importance."

    It really, really is time for Schapiro to resign after this gross public smackdown by a member of the court who has just chided her for not doing precisely what she is paid millions to do.

    That said we can only hope that Rakoff does not drop the ball like he did last time around when he was about to sue Ken Lewis yet pulled out in the last minute.

    Realistically, what happens is SEC will fine Citi with a much greater fine, probably $500MM or so, and Rakoff will end up approving the settlement, because as the status quo slowly implodes, nothing really changes until everything finally crashes.

    The media has been steadily reporting that OWS has no clear agenda and from a selective observance it would seem that way. Personal identifications divide people, so they do show up at the protests with signs they have made, bearing slogans important to them. End the war, Stop Pollution, Education Reform and a few hippie standards like Love & Peace. Those only make up a few of the signs I have seen at Occupy Tampa. (because you have to actually go to a protest to see them, don't trust the MSM)


    A vast majority of signs had the commonality of ending corporate power over politicians and punishing those responsible for the financial meltdown. Signs like End the Fed, Abolish Corporate Personhood, People not Corporations, Banksters are Gangsters and many more along the same theme. The media, doing the work of the 1% are stressing the personal identifications that have always kept us divided and in fear of each other.


    The best thing the Occupy movement has done is to get people talking and researching. This thread like all the others on this site started off with the usual Ad Hominem, Straw Man, Red Herrings and the biggest one of Occupy Wall Street, the False Dichotomy, arguing so that it looks like there are only two choices, republican and democrat. Other sites have done much better.


    At the top of all this world domination is the Banking Royalty.

These are Royalties devoted lackeys and make up the rest of the 1%. Through them, politicians all over the world, on all sides, have been bought and paid for because corporations have been considered people by the judicial system and money is all the voice they need.


    Governments know how to deal with leaders, military and various policing forces know very well how to deal with violence. This is why OWS does not have leaders and stays peaceful. Their message and solution have been there from the start.


    End corporate personhood.
    Punish the bankers that committed fraud.


    This can be done by pressuring the politicians we have and the ones that will come. Not just in the United States but all around the world. This won't stop the Royals and the aRICHtocrats but it will slow them down while we learn better how to deal with them.

    From what I've read I can see that most of you understand the problem and know who is responsible. That's good.

    Now we need a way to take back the government so we can fix the problems.

    Violence will not work because it is just what they want us to do.
    Our getting violet will give them a way to discredit and destroy us by;

    1) Allowing them to label us as out of control criminals.
    2) Give them the excuse to get violent with us... and they have the guns and manpower to do it.

    A better and much easier way is to disarm them. We can do that by depriving them of their protection and power. How do we do that? We make a clean sweep of congress. Get rid of all the politicians that are under their control and who have lead us into our current economic mess.

    We can do that by something I call... "Voter imposed Term Limits."

    All we have to do to accomplish that is to spread the word that voters should NOT VOTE for any candidate, from any party, that has been in office for two or more terms. We don't need a lot of voters to accomplish that since most elections are decided by less than 5 percent of the vote. A 5 percent shift in voting can determine an election.

    Voter Imposed Term Limits will help us get rid of all the politicians that were in office during the economic melt down.

    If we can accomplish this, it will be very disruptive to the plans of Bankers, Lobbyist and other Special Interest Groups that have spent a lot of time and money buying our current crop of representatives.

    What I am proposing is very "do-able" and will produce maximum disruption to their power base. Naturally, they will fight back but they will be weaker and they will have active opposition. That will slow them down and give us time to take other corrective actions.

    This would not be a hard or complicated idea to promote. All we need is for people like you to get behind it... talk about it and spread the word.

    I'm all for voter imposed term limits. However, I am voting for who will come out and state that they are for ending corporate personhood and investigating banker fraud, incumbent or not. Why wait another year? Write your representative today. Get out to a protest in your area. Many incumbents have their entire self worth wrapped up in being a politician and will place their own ego over the money the 1% will offer.
